LAMBDATEST CONFERENCE TERMS AND CONDITIONS

LambdaTest, Inc. ("Company") is committed to contributing to the community and highly values the need to create opportunities for professionals to connect, share information, build knowledge, and learn from the community. To foster this objective, Company conducts events on a periodic basis to encourage the open exchange of ideas and to support professional development and personal growth.


Company always strives to implement robust measures to ensure that its events and gatherings are an inclusive, respectful, productive, and harassment-free.


This document lays down the terms and conditions regarding any conference organized by Company and the rights and obligations of any participant in such conference including any speaker, sponsor, exhibitor or other attendee (collectively, "Attendee" or "you").


BY CLICKING "I ACCEPT," OR BY REGISTERING FOR ANY EVENT OR CONFERENCE OR WEBINAR CONDUCTED/MANAGED BY COMPANY, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND, AS A CONDITION TO YOUR PARTICIPATION IN THE CONFERENCE/EVENT, YOU AGREE TO BE BOUND BY, THESE TERMS AND CONDITIONS, INCLUDING LAMBDATEST'S PRIVACY POLICY. IF YOU ARE NOT ELIGIBLE, OR DO NOT AGREE TO THE TERMS, THEN YOU DO NOT HAVE OUR PERMISSION TO PARTICIPATE IN THE CONFERENCE/EVENT. YOUR REGISTRATION AS A PARTICIPANT/ATTENDEE AND/OR ACTUAL PARTICIPATION IN ANY CONFERENCE/EVENT, CONSTITUTES AN AGREEMENT BY YOU TO BE BOUND BY THESE TERMS.


These terms and conditions shall constitute the entire agreement between Company and Attendee regarding Company conferences and shall supersede any prior or separate understandings and instruments between the parties, provided however that Company may notify Attendees of additional rules and regulations relating to the conference. Company reserves the right at all times to change, amend, add or remove any of the above terms without prior notice. If one or more of the conditions outlined in these Terms & Conditions should be or become invalid, the remaining conditions will continue to be valid and apply.


1. REGISTRATION

  • Registering online will be regarded as an acceptance of these terms and conditions.
  • Company reserves the right to cancel bookings/registrations without notice. In case of any cancellation, Company shall not be liable for any loss or damage suffered by Attendee.
  • If you register for all upcoming TestMu Conference editions, you consent to LambdaTest to share the latest updates about TestMu Conference and related community initiatives with me by email or telephone. You may unsubscribe from receiving LambdaTest news, updates, and offers at any time by following the instructions in the communications received. LambdaTest handles your information as described in the LambdaTest Privacy Notes.

2. PRIVACY

  • Company shall process the personal information supplied in the process of registration as per the terms of Company's privacy policy (https://www.lambdatest.com/legal/privacy), which is incorporated herein by reference.
  • Attendee agrees to be contacted by email, direct mail, or telephone by the Company for the purpose of receiving information about the conference, or about opportunities that Company believes could be something that interests the Attendee.
  • Company may share this information with its partners, vendors and event sponsors.

3. CANCELLATION

If an Attendee wishes to cancel the registration, he/she must inform Company in advance or unsubscribe through the link provided in the registration notification email. He/she can also reach out to support@lambdatest.com or conferences@lambdatest.com.


In case the program is being cancelled by Company, Company shall inform the Attendee via email. Company, event hosts or any other individual associated with the event will not be responsible for any liability for such cancellation.


4. CONTENT, PHOTOS & FILMING

Any content or materials to be used by Attendee in the conference in any way including but not limited to materials/content being presented during any lecture or presentation (collectively, "Content"), must be pre-approved by Company.


Attendee is and will remain the sole and exclusive owner of all right, title and interest in and to all Content, including all intellectual property rights relating thereto, subject to the rights and permissions granted to Company below. Attendee warrants that the Content does not:

  1. infringe any third-party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or
  2. otherwise violate applicable laws and regulations.

Attendee hereby grants Company and its affiliates a perpetual, paid-up, worldwide, royalty-free license to use, reproduce, electronically distribute, transmit, have transmitted, transfer, perform, display, store, archive, and make derivative works of the Content for its internal and external business purposes.


Photos/screengrabs and audio/video recordings (collectively "Recordings") will be taken by Company in the conference for promotional purposes. Attendee hereby consents to be filmed and recorded by Company. Company shall exclusively own such Recordings, and Company shall be free to use the same without restrictions for any legal purpose. You expressly irrevocably assign all rights, title interest to Recordings to Company.


5. ELIGIBILITY, CODE OF CONDUCT AND GUIDING PRINCIPLES

Eligibility: You confirm that you are not a minor, and you possess the legal right and capacity to understand and agree to these terms and conditions.


Code of Conduct: Attendee shall:

  1. Provide a conducive environment that fosters and builds community and positive connections, participants are expected to comply with the following:
  2. Treat all participants and other Attendees with respect and dignity.
  3. Follow all applicable rules and procedures of the event as may be communicated from time to time.
  4. Be mindful of their surroundings and of their fellow participants.
  5. Exercise consideration in Attendee's speech and actions.
  6. Maintain adequate decorum while posting content related to the event on social media handles.
  7. If Attendee is a speaker, be mindful of how much time Attendee consumes in their respective session and ensure that there is no spill-over to the subsequent scheduled session.
  8. Not try to impose or market Attendee's organization/products and pressurize the other Attendees/participants to procure the products. However, giving an overview of Attendee's organisation and products is acceptable.
  9. Refrain from involving in any kind of harassment, bullying, microaggressions, intimidation, and/or insinuations that are hurtful (for instance, using demeaning or discriminatory language, personal insults, sexist, racist language etc.) or interfere with any other Attendees' experience or participation.
  10. Refrain from unwelcome sexual attention, including sexualized comments or jokes, inappropriate or sexually coloured comments.
  11. Not disrupt speakers while they are presenting. Attendees shall ask questions/clarifications during the designated Q&A sessions.
  12. Not include any sexually explicit or violent material in the presentation or Content or in informal settings or on personal devices (e.g. on your phone).
  13. Any other illegal activity or forms of harassment not covered above.

Consequences Of Unacceptable Behaviour

Breach of the above conditions or any other unacceptable behaviour will not be tolerated at any cost. In the event any Attendee is asked by a Company volunteer to stop engaging in unacceptable behaviour, he/ she is expected to comply with the same immediately. If an Attendee breach any of the above conditions or engages in unacceptable behaviour or fails to comply with expected behaviour at any time during the event, Company may take any action it deems appropriate, including but not limited to removing the Attendee from the event without a refund (if applicable).


If Attendees witness or are subjected to unacceptable behaviour or have any other concerns regarding the event, Attendees are requested to contact Company immediately at support@lambdatest.com.


6. WEBSITE & LINKS

The site where the Attendees have to register online for any conference, may also include links to third party websites. These links are provided for the Attendees' convenience to provide further information. They do not signify that Company endorses the third-party website(s). Company has no responsibility for the content of the linked website(s).


7. TRADEMARK

Company and its affiliated companies reserve all rights to their Marks (i.e., Company's name, trademarks, service marks and logos). The Marks are highly valued intellectual property, and therefore Company will take the necessary steps to guard against dilution and the use of third-party marks which are confusingly similar to the Marks or which are likely to cause confusion with Marks.


8. INDEMNIFICATION

Attendee agrees to indemnify, defend and hold harmless Company, its affiliated companies and the respective officers, directors, employees or agents of any such entities from and against any and all claims, liabilities, damages, losses, costs, expenses and fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from (i) Attendee's (or anyone using Attendee's account) violation of these terms and conditions; and (ii) any injury suffered by any person or damage to item caused by or in consequence of any act or omission of any of the Attendee. Company reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by Attendee and, in such a case, Attendee agrees to cooperate with Company's defence of such claim. In no event may Attendee agree to any settlement affecting Company without Company's written consent.


9. DISCLAIMERS

All information, content, products, and services provided in connection with the conference by Company are provided "as is" and "with all faults" with no warranties of any kind. Company shall have no liability for anything said by any speaker, sponsor and/or exhibitor at the conference. Company expressly disclaims to the fullest extent permitted by law all express, implied, statutory or other warranties and representations, including, without limitation, warranties arising from a course of dealing, usage or trade practice. Without limiting the generality of the foregoing, Company makes no warranty that the conference will meet Attendee's requirements.


Except as expressly provided hereunder, to the fullest extent permitted by law, in no event will Company be liable for any direct, indirect, special, consequential, incidental, punitive or exemplary damages, in connection with the participation by an Attendee in any conference or as the result of the services or information provided in the event, whether such damages are based on warranty, contract, tort, statute or any other legal theory and even if Company has been advised (or should have known) of the possibility of such damages.


10. GOVERNING LAW

These terms and conditions and any dispute arising between Company and Attendees shall be subject to the laws of the State of Delaware.


In the interest of resolving disputes between you and Company in the most expedient and cost-effective manner, you and Company agree that every dispute arising in connection with these terms and conditions will be resolved by binding arbitration. This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of these terms and conditions, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND COMPANY ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.
