AI Terms (“AI Terms”)

1. Introduction...

1.1. This AI Terms (“AI Terms”) is incorporated into and made part of the Terms of Service (“Terms”) or the agreement signed between Customer and LambdaTest Inc. (“LambdaTest”),, for the use of AI-powered products and services provided by LambdaTest. The term “Agreement” as used in these AI Terms shall either mean the “Terms” or the agreement signed between Customer and LambdaTest, as applicable. Unless otherwise defined in this AI Terms, capitalized terms shall have the same meaning as given to them in the Agreement.

1.2. The purpose of these AI Terms is to reflect the parties’ agreement with regard to the Customer’s use of LambdaTest AI-powered products and services, in accordance with the requirements of applicable AI laws, regulations, and applicable laws and standards.

1.3. These AI Terms apply to LambdaTest’s generally available AI-powered features, including but not limited to KaneAI (Native Agent), Test Orchestration Intelligence and Platform level AI features & Analytics.

1.4. These AI Terms are aligned with LambdaTest’s AI Principles:

  • Responsible AI: Ensuring fairness, accountability, and explainability, as detailed further in Section 4 below.
  • Customer Trust & Ethics: Protecting data privacy, integrity, and ethical use.
  • Security by Design: Embedding robust security, monitoring, and safeguards in all AI workflows.

2. Customer Responsibilities...

2.1. Lawful Use: Customer is solely responsible for ensuring the legality, appropriateness, and accuracy of all Inputs (including Test execution data, prompts, queries, or other content submitted to LambdaTest AI-powered platform level AI features) are lawful, non-infringing, and compliant with applicable regulations.

2.2. Human Oversight: Customer acknowledges that artificial intelligence and machine learning are rapidly evolving fields of study, and given the probabilistic nature of machine learning, use of LambdaTest AI-powered products and & platform AI Features may, result in Outputs that may not be accurate. Customer must apply reasonable human oversight and review Outputs for accuracy and appropriateness for its use case, before relying on them for critical business decisions or software release activities.

2.3. Restrictions: Customer agrees not to:

  • Use AI-powered & platform level AI Features in violation of the Agreement, these AI Terms, or the Acceptable Use Policy.
  • Employ AI Outputs for harmful, unlawful, or discriminatory purposes.
  • Attempt to reverse-engineer, extract, or misuse any AI Model or framework provided by LambdaTest or its third-party licensors.
  • Use AI-powered & platform level AI Features outside the intended scope of software testing, QA, DevOps, and quality engineering workflows.

3. LambdaTest Responsibilities & Commitments...

3.1. Data Protection & Privacy: LambdaTest will not use Customer Data (including Test execution data, Inputs, Outputs, or Usage Data) to train, re-train, or fine-tune any AI Models made available to other customers.

3.2. Model Integrity: AI Models provided by LambdaTest (including any fine-tuned/customized versions) are made available exclusively for the Customer’s use and are secured within LambdaTest’s governed platform.

3.3. Exclusive Model Use: Any Model customizations (fine-tuned or adapted Models using Customer Data) will be made available exclusively for that Customer’s use and not shared with third parties.

3.4. AI Data Usage: LambdaTest may process anonymized and aggregated AI Data (i.e., Inputs/Outputs that do not constitute personally identifiable information) to improve system performance, monitoring, and platform security, provided such use does not identify Customer or Customer Affiliates or any other party.

3.5. Responsible Use of AI Data: LambdaTest may process anonymized and aggregated AI Data (excluding personally identifiable information) to improve system performance, reliability, and security.

3.6. Third-Party Models & Services: Certain AI-powered & platform level AI Features may incorporate third-party AI Models, APIs, or frameworks (e.g., LLM, APIs, libraries). Where such services are used:

  • Use AI-powered & platform level AI Features in violation of the Agreement, these AI Terms, or the Acceptable Use Policy.
  • LambdaTest ensures compliance with applicable licensing, security standards, and ethical AI principles obligations.
  • Customer must also comply with applicable third-party terms and acceptable use policies as identified in the Documentation

4. Business Ethics & AI Principles...

4.1. Fairness & Non-Discrimination: LambdaTest strives to ensure AI-powered & platform level AI Features are developed and deployed in a manner that reduces bias and promotes fairness, in line with ethical AI standards. Customers are expected to apply human review to prevent harm or unfair decisions.

4.2. Transparency & Explainability: LambdaTest provides documentation, usage guidance, and disclosures to help Customers understand the scope, intended use, and limitations of AI-powered features.

4.3. Human-in-the-Loop: LambdaTest AI features are designed to assist, not replace human testers, developers and DevOps. Customer remains responsible for final decisions.

4.4. Ethical Use of AI: LambdaTest is committed to AI governance practices consistent with its Code of Business Ethics, Responsible AI Principles, and applicable regulations & international AI standards (including ISO/IEC 42001, EU AI Act, GDPR, SOC 2 etc.).

5. General...

5.1. These AI Terms supplement the Agreement. If there is a conflict between these AI Terms and the Agreement, these AI Terms will control solely with respect to the subject matter herein.

5.2. LambdaTest may update these AI Terms to reflect evolving regulatory, ethical, or product requirements, provided such updates do not materially reduce LambdaTest’s obligations during the Customer’s active subscription term.

5.3. Beta AI Features: Any beta, preview, or experimental AI features will also be governed by these AI Terms; provided, however, that the beta AI features may have different reliability, availability, and compliance commitments.

5.4. LambdaTest reserves the right to suspend access to Covered AI Features if Customer is found to be in material breach of these AI Terms or applicable third-party terms.

6. Definitions...

  • Acceptable Use Policy: LambdaTest’s acceptable use policy, available at https://www.lambdatest.com/legal/aup.
  • AI Data: Inputs and Outputs that do not constitute personally identifiable information.
  • AI-powered & platform level AI Features: AI-powered products and services provided by LambdaTest, including KaneAI (Native Agent), Test Orchestration Intelligence, and Platform level AI features.
  • Customer: Any entity that signs an agreement and/or order form to buy a subscription to LambdaTest Services.
  • Customer Data: Data provided, uploaded, or processed by the Customer or on its behalf within the LambdaTest platform.
  • Input: Prompts, queries, test data, or instructions submitted by the Customer to AI-powered products and services & AI Features.
  • Output: The response, result, or AI-generated content provided by LambdaTest AI features in response to an Input.
  • Model: An AI or machine learning model powering an AI-powered products and services & AI Feature, developed by LambdaTest or licensed from third parties.
  • Test execution data: Any information, including but not limited to application data, logs, reports, test artifacts, authentication details, licensing information, and execution metadata (e.g., test status, duration, name, browser sessions, search history) that is uploaded to, processed by, or transmitted through the LambdaTest Services by or on behalf of the Customer during testing. Such data may, but need not, include personally identifiable information (PII) or sensitive PII of customer personnel, end-users, or third parties.
