1. Introduction...

This Acceptable Use Policy (“AUP”) is incorporated into and made part of the Terms of Service (“Terms”), the AI Terms, or any separate agreement entered into between Customer and LambdaTest Inc. (“LambdaTest”), as applicable. “Customer” shall mean any entity that buys a subscription to LambdaTest services whether by entering into an agreement and/or order form or by ordering services online. The term “Agreement” as used herein shall either mean the “Terms” or the agreement signed between Customer and LambdaTest along, as applicable, and the AI Terms.

1.1. The purpose of this AUP is to establish clear rules for the responsible, lawful, and ethical use of LambdaTest’s products and services, including AI-powered features, consistent with:

  • LambdaTest’s AI Principles (Responsible, Transparent, Secure, Fair, Human-Centric).
  • LambdaTest’s Code of Business Ethics and Privacy Policy.
  • Global standards including ISO/IEC 42001 (AI governance), ISO 27001:2022 (security), ISO 27701:2019 (privacy), ISO 27017:2015 (cloud), PCI DSS v4.0, SOC 2 Type II, HIPAA, GDPR, CCPA, DPDP Act (India), and the EU AI Act.

1.2. This AUP applies to all Customers, Customer Affiliates, Users, and third parties who access or use LambdaTest’s platform, APIs, services, or integrations.

2. Permitted Use...

2.1. Customers may use LambdaTest’s AI-powered Cloud Testing platform and services, including KaneAI (Native Agent), Test Orchestration Intelligence and Platform level AI features & Analytics and AI APIs , only for:

  • Software testing, quality assurance, DevOps, and quality engineering workflows.
  • Responsible development, debugging, automation, and optimization of applications.
  • Purposes consistent with the Agreement, this AUP, and applicable laws.

3. Prohibited Use ...

Customers must not use LambdaTest products and services (directly or indirectly) for:

3.1. Unlawful Activities...

  • Violating any applicable law, regulation, or contractual obligation (including data protection, intellectual property, AI governance, and export control).
  • Engaging in fraud, bribery, corruption, money laundering, or other unethical conduct.

3.2. Harmful or Abusive Behavior...

  • Harassing, exploiting, discriminating, or harming individuals, organizations, or protected groups.
  • Generating or transmitting malicious code, malware, spam, or denial-of-service attacks.

3.3. AI-Specific Misuse ...

  • Using AI features to generate inaccurate, biased, unlawful, or unethical outputs.
  • Attempting to disable, bypass, or tamper with AI safeguards, filters, or monitoring mechanisms.
  • Providing harmful or manipulative Inputs intended to create infringing, offensive, or unsafe Outputs.
  • Using AI features for high-risk prohibited purposes under the EU AI Act (e.g., biometric surveillance, predictive policing, social scoring).

3.4. Data & Privacy Violations ...

  • Collecting, processing, or sharing personal or sensitive data without lawful basis or explicit consent (GDPR, CCPA, DPDP).
  • Uploading health, payment card, or protected data (HIPAA, PCI DSS) unless explicitly authorized and compliant.
  • Using LambdaTest services to create datasets for unrelated AI model training without authorization.

3.5. Platform Abuse...

  • Reselling, sublicensing, or redistributing LambdaTest services without authorization.
  • Misusing APIs or features to overload, disrupt, or degrade LambdaTest systems or other customers’ environments.
  • Circumventing access controls, security mechanisms, or account protections.

4. Fair Usage Policy (FUP) & Guidelines ...

LambdaTest is committed to ensuring optimal availability, reliability, and equitable resource distribution across it's global customer base. To achieve this, LambdaTest implement a Fair Usage Policy (FUP) that balances customer needs, prevents misuse, and promotes best practices in test execution. FUP limits for each LambdaTest product are communicated to each customer at the beginning of the customer's subscription plan.

LambdaTest’s FUP safeguards the platform’s availability, reliability, and fairness by balancing time-based and resource-based usage. By adhering to this policy, customers help maintain an equitable environment that ensures consistent performance for all users.

i. Time-Based Fair Usage

  • Each organization is entitled to a maximum daily test execution duration.
  • Individual user limits may also apply to prevent single-user overuse or excessive usage of test execution slots.
  • Idle sessions and unnecessarily long-running tests are subject to automatic termination after a defined timeout.

ii. Resource-Based Fair Usage

  • To ensure equitable distribution, limits are applied to specific resource types such as:
  • High-demand OS/browser/device combinations.
  • Specialized test configurations or infrastructure.
  • An organization may not consume more than a pre-defined proportion of any unique resource pool at a given time.
  • Excessive concurrent usage of the same configuration may be queued or throttled to allow fair access for others.

4.1. Enforcement Mechanisms...

LambdaTest monitors system-wide usage patterns to identify excessive or unfair consumption.

  • Monitoring: LambdaTest continuously monitors test execution usage and infrastructure demand.
  • Notification: Customer exceeding thresholds will receive usage alert with recommended corrective actions.
  • Throttling /Queuing: Test beyond applicable FUP limits, as communicated to customer, may be delayed or deprioritized during peak times.
  • Suspension of Misuse: Persistent violation or exploitation (e.g., automated attempts to bypass limits) may result in temporary suspension or restricted access.
  • Enterprise Subscription Exception: Customers with higher contracted limits (Enterprise Plan) may receive customized limits.

4.2. Customer Responsibilities & Best Practices...

We encourage customers to:

  • Use parallel testing strategically rather than extending test duration.
  • Release unused/idle sessions promptly.
  • Distribute tests across different browsers, devices, and configurations.
  • Plan and schedule tests efficiently to optimize allocated time.
  • Work with LambdaTest support team or Account Manager for enterprise- level capacity planning.

4.3. Continuous Improvement ...

  • FUP thresholds are reviewed periodically to adapt to evolving usage patterns, capacity upgrades, and customer needs.
  • Global regulatory requirements (ESG-linked resources transparency, GDPR, AI Act)
  • Cloud Infrastructure scaling and capacity upgrades
  • Industry benchmarks (e.g., SaaS and Software testing norms)

By following the FUP, customers contribute to a sustainable, reliable, and industry-standard testing ecosystem.

5. Responsible AI & Business Ethics ...

5.1. Human Oversight: Customers must apply appropriate human review and judgment before relying on AI-generated outputs for software release, compliance, or decision-making.

5.2. Bias & Fairness: Customers may not use LambdaTest platform AI features to enable discriminatory practices, violate human rights, or create unfair treatment.

5.3. Transparency & Explainability: AI-assisted decisions in testing and development must remain transparent and explainable in context.

5.4. Alignment with Ethics: Use of LambdaTest planform AI features must align with LambdaTest’s Code of Business Ethics, ensuring fairness, trust, accountability, and compliance with global standards.

6. Third-Party AI Models & Services ...

6.1. Some LambdaTest Quality Engineering Platform and platform AI features may incorporate third-party AI models, APIs, or frameworks.

6.2. Customers must comply with any applicable third-party acceptable use policies communicated by LambdaTest or included in Documentation.

7. Data Protection & Privacy ...

7.1. Customers must comply with applicable laws (GDPR, CCPA, DPDP Act, HIPAA, etc.).

7.2. Prohibited Data Uploads: Unless expressly authorized, Customers must not upload or process:

  • Payment card data (PCI DSS)
  • Protected health information (HIPAA)
  • Government-classified or export-controlled data
  • Biometric identifiers or sensitive personal data without explicit consent

8. Monitoring, Enforcement & Violations...

8.1. LambdaTest may monitor service usage for compliance with this AUP, the AI Terms, and the Agreement.

8.2. Violations of this AUP may result in:

  • Warning or notification of non-compliance.
  • Suspension or termination of access to services.
  • Reporting of unlawful activities to regulators or authorities.
  • Legal liability under applicable laws.

8. Updates to this AUP...

LambdaTest may amend this AUP from time to time to reflect changes in the law and at LambdaTest’s sole discretion. If we make any material changes to this AUP, we will either notify you by email (sent to the email address specified in your account) or by means of a notice on or within the Services prior to the change becoming effective, or as otherwise required by the applicable law. We encourage you to periodically review the Website for the latest information on our AUP practices. Your continued use of the Services after any change in this AUP takes effect will constitute your acceptance of such change.
